Creator Terms

These Creator Terms govern the relationship between you (the "Creator") and Tranced Media (the "Platform") when you upload, distribute, or monetise content on Tranced. They sit alongside the general Terms of Service, the Privacy Policy, the 18 U.S.C. 2257 Statement, and the Billing Policy, all of which apply to you in your capacity as a Tranced user. Where there is a conflict between these Creator Terms and the general Terms in matters specific to creator activity, these Creator Terms control.

By uploading any content to Tranced, you accept these terms. If you do not accept them, you must not upload content. Continued uploading after a published amendment constitutes acceptance of the amended terms.

1. Eligibility and Verification

1.1 Verified-Creator Status

Upload capability is granted only to verified creators. Verification requires:

  • Account in good standing (no active suspensions, no unresolved chargebacks)
  • Successful Tranced age verification (18+, via Yoti)
  • Acceptance of these Creator Terms
  • Operator approval (we manually review applications during the seed-launch period)

1.2 No Implied Right

Operator approval is at our sole discretion. Application does not entitle you to verification. We may decline applications without reasoned response.

1.3 Continuing Eligibility

Verification can be revoked at any time for cause (see Section 11). Lapse in age-verification status, unresolved compliance issues, or repeated content removals may also trigger review.

2. Content Ownership and Licence

2.1 You Retain Ownership

You retain all intellectual property rights in the content you upload. Tranced does not claim ownership of creator-uploaded content.

2.2 Licence Granted to Tranced

For each piece of content you upload, you grant Tranced a non-exclusive, worldwide, royalty-free, sublicensable licence to:

  • Host and store the content on our infrastructure (Bunny.net CDN, Supabase)
  • Encode, transcode, and adapt the content for delivery (adaptive streaming, thumbnail generation, preview clips)
  • Display the content to users in accordance with the access tier you select for it
  • Include the content in search, recommendation, and discovery features within the Platform
  • Generate cover art and preview previews for the content
  • Promote the content within the Platform (e.g., featured placement, in-app notifications) with your consent. Promotion outside the Platform requires separate written consent.

This licence persists for as long as the content remains on the Platform. When you remove a piece of content, the licence terminates within 30 days (the time required for our backups and CDN caches to roll over).

2.3 Exclusive Content

You may flag a piece of content as "Tranced exclusive," meaning it is not published on any other platform. Exclusive flagging is voluntary and qualifies you for an elevated revenue share (see Section 3). You warrant that exclusive content is in fact exclusive at the time of flagging; we may remove the flag and the elevated share if we discover the content elsewhere.

2.4 Removal by You

You may remove any piece of content at any time via Creator Studio. Removal is propagated within minutes; backups and CDN caches roll over within 30 days. Earnings already accrued for the content are not affected by removal.

3. Revenue Share and Earnings

3.1 Tier Ladder for Video Creators

Base share is what you start at when you reach a tier. Maximum share is what you can earn back via the multipliers in Section 3.3. Tier movement is reviewed monthly; tier-down notifications come 30 days in advance with the specific reason.

3.2 Other Creator Types

  • Shorts creators: Lower base share than video, scaled by quality and completion rate. Specifics in Creator Studio.
  • Audio creators: Same ladder as video creators.
  • Art creators: Revenue share on Veil unlocks of your art (e.g., behind-The-Moment Veil unlocks).
  • Blog creators: Revenue share on premium reads and Veil unlocks of premium posts.
  • Companion creators: Revenue share on tip-in-character spend, custom-companion subscription if enabled, and Veil-spent against the companion. Quality score and usage volume determine effective share.
  • Exclusive creators (any type): Elevated cut on the underlying type's scale, conditioned on the content being Tranced-exclusive per Section 2.3.

3.3 Multipliers

Multipliers operate within the tier's base-to-maximum band. You earn them back from the base by hitting the following over a 30-day rolling window:

  • Quality: audience retention, repeat-watch rate, ratio of finishes to starts.
  • Exclusivity: proportion of your library flagged as Tranced-exclusive.
  • Consistency: regular uploads (no cliff after a single hit; no quota either; reward for sustained presence).
  • Conversion: share of your viewers who subscribe or convert to higher tiers after watching your content.

The exact multiplier weights are tuned for platform health and may change. You are notified of changes 30 days in advance with effective date and rationale. We do not change historical earnings retroactively.

3.4 Zero Obligation

No posting schedule. No minimum upload volume. No exclusivity contract (except per-piece exclusivity per Section 2.3). You may pause uploading indefinitely without losing your tier, with the caveat that prolonged inactivity (90+ days) may move you down a tier when activity resumes, on review.

4. Earnings Calculation

4.1 Subscription Revenue Attribution

Subscription revenue is attributed to creators based on watch-time and engagement weighting in the billing month. The exact attribution model is published in Creator Studio and updated when changed. Multiple creators sharing a viewer's subscription month share the attribution proportionally.

4.2 Veil Spend Attribution

When a viewer spends Veil to unlock a piece of your content, your tier's revenue share applies to that Veil's euro equivalent (€0.01 per Veil at the base rate; bundle pricing varies, attribution uses the per-Veil weighted average).

4.3 Tips Direct to Creator

Direct tips through the Platform are attributed at a flat 90% share (the same rail as Seed) regardless of your tier. We retain 10% to cover payment processing and chargeback risk.

4.4 Statements

Earnings are calculated daily and statementised monthly. Your Creator Studio dashboard shows running totals; the formal monthly statement is generated within 7 days of month-end and is available in Creator Studio.

4.5 Refunds and Chargebacks

If a viewer's subscription period is refunded or successfully charged back, attribution is reversed and the previously credited share is deducted from the next month's payout. Bonus Veil credit (per Billing §6.2) is not refundable and does not generate creator attribution.

5. Payouts

5.1 Payout Threshold

Minimum payout balance: €50.00. Below this threshold, balance carries to the following month indefinitely (no expiry on accumulated balance while your account is active).

5.2 Payout Schedule

Payouts run monthly, on or about the 5th of the following month, for balances above the €50 threshold as of the prior month-end. Holiday delays may shift the date; you receive an email when the payout is initiated.

5.3 Payout Rails

You select your payout rail in Creator Studio. Available options:

  • ePayService, primary recommendation. Supports US, EU, and most non-EU jurisdictions. Minimum payout €50.
  • USDT TRC-20, fallback for jurisdictions ePayService cannot serve. Wallet address required. Network fees deducted from payout.
  • SEPA bank transfer, for EU creators with an EU IBAN. Free, 1-3 business days.

You may switch rails at any time; the switch applies to the next scheduled payout. Failed payouts due to incorrect details are retried after you correct them and incur no fee.

5.4 Tax Form Requirement

Before your first payout, you must submit a valid tax form via Creator Studio:

  • US creators: IRS Form W-9 (Request for Taxpayer Identification Number and Certification)
  • Non-US creators: IRS Form W-8BEN (Certificate of Foreign Status of Beneficial Owner)

Tax forms are stored encrypted, retained 7 years per US IRS requirements, and disclosed only to tax authorities upon valid request. You may upload a new form at any time if your status changes.

5.5 1099-NEC (US Creators)

US creators with combined annual earnings of $600 or more receive Form 1099-NEC by January 31st of the following year, sent electronically to the email on file. You are responsible for reporting your earnings on your tax return regardless of whether you receive a 1099.

5.6 Tax Responsibility

You are solely responsible for all taxes on your earnings. Tranced does not withhold taxes from payouts (except where required by treaty for certain non-US recipients of US-source income). VAT registration, if required in your jurisdiction, is your responsibility.

6. 18 U.S.C. 2257 and Performer Records

6.1 You Are the Primary Producer

For any sexually explicit visual content you upload, you are the "primary producer" under 18 U.S.C. § 2257 and 28 C.F.R. § 75. Tranced is the "secondary producer." The full obligations for primary producers under U.S. federal law apply to you whether or not you are based in the United States, because the content is distributed in the U.S. via the Platform.

6.2 Required Records

For every sexually explicit visual depiction you upload, you must maintain:

  • Government-issued photo identification for each performer (passport, driver's licence, or national ID)
  • Proof of date of birth showing the performer was 18 or older at the time of production
  • Date of production of the content
  • Performer's legal name as it appears on identification
  • Records of consent for the specific content uploaded

Retention period: 7 years from the date of last distribution (longer of U.S. federal requirement and any local jurisdiction requirement).

6.3 Per-Upload Certification

Each upload requires you to certify, under penalty of perjury and account termination, that all performers were 18 or older at the time of production and that you maintain the records required by Section 6.2. Certifications are logged.

6.4 Records Available on Request

You agree to provide complete 2257 records to Tranced within 5 business days of a written request. Failure to provide records on request results in immediate removal of the relevant content and may result in account termination.

6.5 Cooperation with Authorities

You agree to cooperate with any law-enforcement inquiry concerning your content, and to grant Tranced authority to disclose your records to law enforcement under valid legal process.

7. Consent and Performer Welfare

7.1 Affirmative Consent Required

You warrant that every performer in your content gave informed, affirmative consent to:

  • Participation in the production
  • The specific acts depicted
  • Distribution of the content via Tranced and any other platform on which it appears
  • The retention period for which the content remains available

7.2 Performer Right of Withdrawal

If a performer in your content withdraws consent (in writing, to you or to Tranced), the content must be removed within 14 days of the withdrawal request. Tranced will assist in implementing removal.

7.3 Self-Production

If you are the only performer in your content, the consent and welfare warranties of this section apply to you in respect of yourself.

8. Prohibited Content

The following content is strictly prohibited and will result in immediate removal, account termination, and reporting to authorities where applicable:

  • Any depiction of, or that appears to depict, persons under 18 in any sexual context (CSAM)
  • Non-consensual depictions of real persons (including deepfakes of identifiable persons without consent)
  • Revenge porn or non-consensual intimate imagery
  • Content depicting actual sexual assault, coercion, or exploitation
  • Bestiality
  • Content promoting real-world violence against specific persons
  • Content depicting actual illegal activity (drug use during production, trafficking, etc.)
  • Content that violates the rights of third parties (copyright, trademark, publicity rights, privacy)

The line between fantasy roleplay and real depiction is the consent standard. Fictional non-consent fantasy between consenting adults is permissible if labelled clearly; depiction of actual non-consent is not.

9. Platform Moderation Rights

9.1 Removal at Discretion

Tranced reserves the right to remove any content at any time, with or without notice, for any reason including:

  • Suspected violation of these Creator Terms or the general Terms of Service
  • Suspected illegality
  • Quality concerns (e.g., misleading title, broken upload, thumbnail violation)
  • DMCA or other rights complaints (see Section 10)
  • Operator judgment of risk to platform standing

Where notice is feasible, we provide it. Where notice would risk evidence preservation (e.g., suspected CSAM), removal precedes notice.

9.2 Appeal

If your content is removed and you believe it was in error, you may appeal via creatorcontact@tranced.me within 14 days of removal. Operator decision on appeal is final, except for DMCA counter-notice procedures (Section 10).

10. DMCA and Third-Party Rights

10.1 You Warrant Clear Rights

By uploading content, you warrant that you hold all necessary rights to the content, including all elements depicted, all music, and all third-party material incorporated. You agree to indemnify Tranced for any claim arising from a breach of this warranty.

10.2 DMCA Counter-Notice

If your content is removed in response to a DMCA notice and you believe the removal was wrongful, you may submit a counter-notice per the DMCA Policy. Submission of a counter-notice is a sworn statement under penalty of perjury.

10.3 Repeat Infringer Policy

Three substantiated DMCA strikes within 12 months results in account termination. Counter-notices that succeed do not count as strikes. Termination on this ground is a removal not a termination for cause; outstanding earnings are paid out per Section 5.

11. Termination

11.1 Termination by You

You may terminate your creator status at any time by removing your content and deactivating your creator profile in Creator Studio. Outstanding earnings above the payout threshold are paid out on the next scheduled payout date. Earnings below threshold are paid out as a final balance within 60 days.

11.2 Termination by Tranced for Cause

We may terminate your creator status immediately and without prior notice for:

  • Verified upload of CSAM or other prohibited content per Section 8
  • Material breach of 2257 obligations (Section 6); specifically, failure to provide records on lawful request
  • Repeat copyright infringement per Section 10.3
  • Fraud, including fake performers, ID falsification, or attempted manipulation of attribution metrics
  • Bad-faith chargebacks against Platform earnings
  • Conduct directed at viewers, other creators, or staff that constitutes harassment or threats

Termination for cause forfeits any unpaid earnings if the cause is one of: CSAM, fraud, or impersonation. For other causes, accrued earnings are paid out on the next scheduled payout subject to any chargeback offsets.

11.3 Effect of Termination

On termination, your content is removed from public view. Backup copies and audit trails (including 2257 certifications) are retained per the legal retention periods that apply (typically 7 years for tax and 2257 records).

12. Reporting and Transparency

12.1 Creator Studio Dashboard

Your Creator Studio dashboard shows: running earnings for the current period, attribution by content piece, audience retention metrics, and tier status. Data is updated daily.

12.2 Monthly Statement

Within 7 days of month-end, a formal statement is generated showing: gross attribution, applicable revenue share rate, deductions (refunds, chargebacks, network fees on USDT), and net amount payable.

12.3 Transparency on Tier Movement

Tier-down decisions are accompanied by the specific reason and the 30-day window before the new rate takes effect. Tier-up takes effect at the start of the next billing cycle and is announced at the time of the change.

13. Confidentiality

Information shared with Tranced under these Creator Terms (including business plans, audience data, performer identities, and tax information) is held in confidence and disclosed only as required for service operation, legal compliance, or with your written consent.

14. Modifications to These Terms

We may update these Creator Terms. Material changes (revenue share, payout terms, prohibited content scope, termination grounds) are notified at least 30 days in advance via email and Creator Studio banner. Non-material changes (clarifications, contact updates) take effect on publication. Your continued upload activity after the effective date of an amendment constitutes acceptance of the amended terms.

15. Dispute Resolution

15.1 Direct Resolution First

If a dispute arises, contact us at creatorcontact@tranced.me. We respond within 5 business days. Most disputes are resolved without escalation.

15.2 Governing Law

These Creator Terms are governed by Danish law and applicable EU law. Disputes are subject to the exclusive jurisdiction of the courts of Denmark.

15.3 EU Consumer Rights

Where you are a consumer under EU law, mandatory consumer protections in your country of residence apply notwithstanding the choice of Danish law. Nothing in these Creator Terms limits non-waivable statutory rights.
